Recently a paid army of right-wing commentators has been engaging in an unusually public, concerted effort to get the Supreme Court to intervene in the first of the ExxonKnew cases moving to trial in a Hawaii state court. On June 10h SCOTUS announced they were asking the Justice Department to file briefs in the Hawaii state cases Honolulu vs. Shell and Honolulu vs. Sunoco. It seems they’re considering a major intervention, yanking the cases out of state court and into federal courts where Trump-appointed judges can rule. It’s nearly unprecedented to intervene at this early stage–federal courts are supposed to wait until state court decisions become final. By engaging now, SCOTUS is at least delaying all the state ExxonKnew cases until after the election. That could help Trump.
